By creating an account, uploading music, or using our platform, you agree to be bound by these Terms. If you do not agree, please refrain from using our services.

2. Eligibility

You must be at least 18 years old or have verifiable consent from a parent or legal guardian to use Q Phonic ENT's services.

You agree that all information you provide during registration and use of the platform is accurate, truthful, and complete.

3. Ownership and Copyright Compliance

By uploading any music, artwork, or related content ("Content") to Q Phonic ENT, you confirm that:

• You are the rightful owner of the content, or
• You have full and valid authorization from the copyright holder to distribute it.

Uploading, distributing, or claiming ownership of copyrighted or unauthorized works is strictly prohibited.

Violations may result in:

• Immediate account suspension or termination,
• Removal of all distributed content, and
• A $20 USD penalty per violation to cover administrative and legal costs.

Q Phonic ENT reserves the right to pursue legal action against any user found to be distributing illegal or infringing content.

4. Royalties and Withdrawals

Earnings from your distributed content will be credited to your account.

• The minimum withdrawal amount is $50 USD.
• Payments will be made using the payment details provided in your account.

The Company is not responsible for any losses resulting from incorrect or outdated payment details supplied by the user.

All withdrawal requests are reviewed for accuracy and compliance before being processed.

5. Prohibited Content and Activities

You agree not to upload or distribute:

• Unauthorized, pirated, or infringing content,
• Material containing hate speech, defamation, or illegal activities,
• Manipulated streams or fraudulent reporting data, or
• Any other content that violates applicable laws.

Violations of these rules may result in:

• Permanent account termination,
• Removal of all distributed content,
• Forfeiture of any unpaid earnings, and
• A $20 penalty for each confirmed infraction.

6. Account Termination

Q Phonic ENT reserves the right to suspend or terminate any account at its sole discretion if it violates these Terms or engages in unethical, fraudulent, or illegal behavior.

Terminated accounts may lose access to funds or content.

We also reserve the right to take civil or criminal legal action where necessary.

7. Liability and Indemnification

You agree to indemnify, defend, and hold harmless Q Phonic ENT, its owners, employees, and partners from any claims, losses, or damages arising from:

• Your uploaded or distributed content,
• Misuse of the platform,
• Violation of these Terms, or
• Any third-party claims related to your actions.

Q Phonic ENT is not responsible for loss of income, reputation, or damages caused by your actions or those of third parties.

8. Protection of Clients Against Defamation

Q Phonic ENT prioritizes the safety and reputation of its clients. The Company will take all reasonable steps to protect clients against false accusations, slander, or defamatory statements made by any third party.

• Individuals or parties who make false, misleading, or defamatory claims against our clients shall not be guaranteed any safety, protection, or privacy by Q Phonic ENT.
• Q Phonic ENT may take legal or other protective measures on behalf of its clients to prevent harm or reputational damage.
• By engaging with the platform, users acknowledge that any defamatory actions toward our clients carry full personal responsibility for legal and reputational consequences.

9. Public Accusations and Defamation

Q Phonic ENT maintains a zero-tolerance policy toward false, misleading, or defamatory statements made against the Company, its staff, or partners — whether publicly (e.g., social media, forums) or privately.

Any attempt to harm or defame the Company's reputation may result in:

• Immediate account suspension or termination,
• Forfeiture of pending earnings, and
• Legal action to protect Q Phonic ENT's reputation and interests.

Furthermore, Q Phonic ENT cannot guarantee the safety, privacy, or protection of any individual who engages in defamatory or slanderous acts toward the Company.

By making public accusations or false claims, you acknowledge that you assume full personal responsibility for any legal or reputational consequences that follow.

10. Legal Action and Enforcement

Q Phonic ENT reserves the right to pursue legal and financial remedies against any user who:

• Uploads illegal or infringing content,
• Commits fraud or manipulation,
• Defames or damages the Company's reputation, or
• Causes financial or operational harm to the platform.

The Company may also share relevant information with legal authorities where required by law.

11. Limitation of Liability

Our platform and services are provided "as is" without any express or implied warranties. Q Phonic ENT does not guarantee sales, streams, exposure, or distribution success.

We are not liable for any indirect, incidental, or consequential damages, including but not limited to loss of income, data, or goodwill arising from the use or inability to use our services.

12. Modifications to the Terms

Q Phonic ENT may update these Terms and Conditions at any time without prior notice. Your continued use of the platform after updates constitutes acceptance of the revised Terms.

13. Governing Law

These Terms shall be governed by and construed under the laws of South Africa, and all disputes shall be subject to the exclusive jurisdiction of the courts of South Africa.
